These Terms & Conditions ("Terms") govern your access to and use of fitchek, including the fitchek Shopify app, the fitchek try-on experience (online and in-store), fitchek Studio, and our websites (together, the "Service"). The Service is operated by Coderapper ("fitchek", "we", "us", "our"), a limited liability partnership registered in India (LLPIN AAG-6889), with its registered office at 888, First Floor, 7th Main, 4th Cross, HAL 2nd Stage, Bangalore, Karnataka 560008, India.
By installing, accessing, or using the Service, you agree to these Terms, together with our Privacy Policy. If you do not agree, please do not use the Service. If you are using the Service on behalf of a business (for example, as a merchant), you confirm you have authority to bind that business to these Terms.

Who can use fitchek
You must be at least 18 years old, or the age of majority in your location, to enter into these Terms. The try-on experience is not intended for use by children. If you use fitchek on behalf of a store, you are responsible for your store's compliance with these Terms.
The Service
fitchek lets shoppers try products on using AI — from a photo or a short live video — on a merchant's online store or on a screen in a physical store. It also provides merchants with a dashboard, analytics, and (through fitchek Studio) AI-generated catalog images. We may add, change, or remove features over time.
Accounts
To use certain parts of the Service, you or your store may need an account, typically created through Shopify. You are responsible for the accuracy of the information you provide, for activity that happens under your account, and for keeping your credentials secure. Tell us promptly if you believe your account has been used without permission.
Fees and billing
Paid plans and usage-based charges are described on our pricing page and are billed through Shopify's billing system. You agree to the charges for the plan and usage you select. Except where required by law, fees and used allowances are non-refundable. We may change our pricing on a going-forward basis, with notice as required by law or Shopify's rules.
Acceptable use
You agree to use the Service lawfully and responsibly. You must not, and must not allow anyone else to:
• upload or process any image or video of a person without that person's clear knowledge and consent;
• use the Service to create content that is unlawful, infringing, deceptive, defamatory, harassing, hateful, or that violates anyone's privacy or rights;
• create, distribute, or facilitate any child sexual abuse or exploitation material, or sexualize, fetishize, or endanger a minor in any way;
• generate misinformation, fake reviews, or content presented as authentic news or evidence;
• use the Service for biometric identification, surveillance, social scoring, emotion inference, or any use prohibited under applicable AI or privacy law;
• infringe, misappropriate, or violate any third party's intellectual-property, trademark, or privacy rights — including by uploading brand imagery, product photos, or logos you do not have the right to use;
• attempt to reverse-engineer, scrape, overload, disrupt, or circumvent the security or usage limits of the Service;
• remove or alter any AI-generated markings, watermarks, or metadata where their removal is restricted by law.
Where required by law, you must disclose that content has been generated or manipulated by AI. Some of these requirements flow from the terms of our own technology providers, and you agree to comply with them as a condition of using the Service. We may suspend or terminate access, remove content, and where required report to authorities, if these rules are breached.
Your content and rights
Merchant and shopper content. "Your Content" means the images, videos, product data, and other materials you or your shoppers provide to the Service. As between you and fitchek, you (or your shoppers) retain ownership of Your Content. You grant fitchek a limited licence to process Your Content solely to provide and operate the Service.
Try-on results. Subject to your compliance with these Terms, the try-on results generated for a shopper are for that shopper's use, and product-based results are provided to support the merchant's store.
No AI training. We do not use Your Content to train AI models. Our providers process Your Content only to generate results; our live-video provider operates under a zero-data-retention agreement.
Your responsibility. You represent that you have all rights and permissions needed for the content you upload and for the way it is used in the Service — including the consent of any person shown, and the rights to any brand, product, or logo imagery. You are responsible for Your Content and for your use of any results.
Our intellectual property
The Service itself — including our software, models, designs, text, graphics, logos, and the "fitchek" name and marks — belongs to Coderapper or its licensors and is protected by law. These Terms don't give you any right to use our name, logo, or marks without our prior written permission, except as needed to use the Service normally. We welcome feedback and may use it without obligation to you.
Third-party services
fitchek works with third-party services, including Shopify and our AI providers. Your use of the Service may also be subject to those parties' terms. We are not responsible for third-party services we don't control, and your relationship with Shopify (or any other platform you connect) is governed by that platform's own terms.
AI-generated results — accuracy
fitchek uses AI to generate try-on results. Because of how AI works, results are approximations: they may not be perfectly accurate, may vary between attempts, and may not exactly reflect how a product looks, fits, or drapes in real life. Results are meant to help a shopper visualize a product, not to guarantee fit, size, colour, or appearance. You should not rely on a result as a precise representation, and fitchek is not responsible for purchase or return decisions made based on a result.
Service availability
We work to keep the Service running well, but we provide it "as is" and "as available." The Service may occasionally be unavailable for maintenance, updates, or reasons beyond our control, and we don't guarantee it will be uninterrupted, error-free, or free of security issues.
Disclaimers
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or any result will be accurate, reliable, or meet your requirements.
Limitation of liability
To the fullest extent permitted by law, fitchek (Coderapper) and its partners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Service.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the total fees you paid to fitchek for the Service in the three (3) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits any liability that cannot be limited by law.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless fitchek (Coderapper) and its partners, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law or any third party's rights — including intellectual-property, trademark, or privacy rights.
Suspension and termination
You may stop using the Service and uninstall the app at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or others. On termination, your right to use the Service ends. Sections that by their nature should survive — including content, intellectual property, disclaimers, limitation of liability, and indemnity — will survive termination.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we'll update the date above and, where appropriate, notify you in-app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of India, and the courts at Bangalore, Karnataka, India, will have jurisdiction over any dispute, subject to any mandatory rights you have under the laws of your own country.
